Rep. Madison Cawthorn Faces Voter Challenge

A group of voters from North Carolina’s 11th District claim that Republican Representative Madison Cawthorn should be disqualified from running for reelection because he violated Section 3 of the United States Constitution’s 14th Amendment, according to WUNC. Section 3 prohibits a government official from running for office “if they previously swore an oath to the Constitution and subsequently engaged in an insurrection.” 

The group claims that Cawthorn did this by speaking at the January 6th, 2021 rally ahead of the insurrection on the capitol and repeatedly promoting baseless claims that the 2020 presidential election was “stolen.”

Cawthorn’s request to block the State Board of Elections from proceeding with the challenge was granted by Judge Richard Myers of North Carolina’s Eastern District last month. The group has now appealed the request to the federal 4th Circuit.

Oral arguments at the 4th Circuit will begin on May 3rd. If the court grants the group’s appeal, the NC Board of Elections will likely have to re-start the challenge process. 

Cawthorn is currently facing a crowded Republican primary in North Carolina’s 11th district.
